General Terms and Conditions

I. Acceptance and Storage of Letters, Small Parcels, Packages, Freight Goods, etc. by Swiss Paket

1. Scope / Contractual Basis

  1. These General Terms and Conditions (hereinafter T&C) regulate the contractual legal relationship between the company Swiss Paket and its customers (hereinafter the Client). These conditions apply to all services provided or arranged by Swiss Paket for its Clients. The current version of the T&C applies, which is available at the Swiss Paket office and is accessible to every customer during registration, and is confirmed by the registration.
  2. The contractual relationship is concluded exclusively under these T&C. Deviating regulations in individual cases require an explicit written agreement. The contract is concluded by the Client's written order and the subsequent acceptance by Swiss Paket.
  3. Services / Prices: The latest current version of the price and service overview applies. Conflicting T&C of the Client are expressly rejected.
  4. In addition, the currently valid regulations for the packaging and labeling of shipments apply.
  5. Furthermore, the provisions of § 407 ff. HGB (German Commercial Code - Freight Business) apply supplementarily.
  6. Please note that Swiss Paket acts exclusively as a delivery address, but in no case as a billing address. It is expressly prohibited to state Swiss Paket or its business address as the billing address. Likewise, no Swiss Paket email address may be given as a correspondence address for third parties. Swiss Paket does not forward messages sent to customers (Post/Fax/Email/SMS), nor are clarifications made with external senders. A violation of this provision will result in the blocking of the customer number. Your Swiss Paket delivery address is not your residence but merely a pickup address.

2. Description of Services

  1. In cooperation with connected system partners, Swiss Paket accepts and stores shipments on behalf and in the name of the Client. This order is provided to Swiss Paket as a written power of attorney for acceptance in connection with the Client's registration on SwissPaket.de.
  2. The Client authorizes Swiss Paket to accept and store shipments from delivery services (suppliers) addressed to "c/o Name [Swiss Paket Customer Number]" of the Client.
  3. The customer identifies themselves before pickup by presenting an ID card, passport, or identity card and stating their customer number. Digital ID documents are excluded and will not be accepted. A power of attorney can be issued for other persons; to do this, log into your customer account and create a power of attorney online. These can also be managed there. A cardholder must collect the first delivery in person on-site for identification before authorizing other persons.
  4. Prices for the delivery address or depot service are to be paid upon collection in cash (Euro or CHF) or by card (EC or credit card). Please note that not all EC and/or credit cards are accepted (card payments possible from €5.00).
  5. Current prices can be viewed on the website www.swiss-Paket.de or in the branches. By registering, you accept these. Fees apply to all stored parcels; this also applies to parcel service providers who may offer free pickup!
  6. Shipments that are not labeled according to our specifications will be charged an additional fee of €2.00. The addressing on the parcel label is decisive. Please follow all information in your welcome email or in your customer account.

3. Contractual Relationship

  1. The order is considered completed upon delivery of the stored shipment to the c/o recipient or an authorized representative.
  2. Swiss Paket reserves the right to refuse an order for acceptance and storage at any time and without giving reasons.
  3. Swiss Paket is entitled, after taking over a shipment from the respective deliverer (supplier), to request information from the Client regarding the contents of the shipment(s) to determine if it complies with conditions. If the Client refuses to provide information, or if information cannot be obtained in time, Swiss Paket is entitled to open and inspect the contents if there is reason to suspect the shipment does not comply with these T&C.
  4. Termination of the contractual relationship by the Client after delivery and acceptance of the shipment by Swiss Paket is excluded.

4. Condition-Compliant Shipments

  1. Swiss Paket accepts and stores all shipments for which a written order with power of attorney for acceptance exists (registration), and which meet the valid price and service overview as well as packaging and labeling regulations. An exception is the first delivery of a parcel (for new customers), for which a written power of attorney (registration) can only be prepared and signed during the customer's first visit.

5. Insurance

  1. Swiss Paket is not liable for the condition or content of shipments delivered to and accepted by Swiss Paket employees.
  2. Swiss Paket is not liable for consequential damages or costs such as purely economic losses, loss of profit, or loss of revenue, expenses for substitute performance, or damages caused by delays in processing. Liability for damages other than goods is limited to three times the storage fee calculated for the shipment in question per claim.
  3. The assignment or pledging of claims by the recipient without the consent of Swiss Paket is excluded.

6. Notification of Claims / Statute of Limitations / Unidentifiable Shipments

    As a rule, Swiss Paket will not accept shipments with obvious damage without a verifiable damage scan. The clarification of damage cases concerning delivered shipments is not the responsibility of Swiss Paket and must be handled with the respective sender or delivery service. Swiss Paket agrees to take photos of damaged goods and provide them to the customer, provided a documentation device is available on-site.
  1. All damages, even if not externally recognizable, must be reported immediately within the business area of Swiss Paket and recorded in writing.
  2. Insurance coverage begins upon the written confirmation of acceptance of the shipment by a Swiss Paket employee and expires as soon as the shipment leaves the Swiss Paket building or after the written takeover confirmation by the person picking it up.
  3. All claims against Swiss Paket that are not asserted expire after 6 months. The limitation period begins with the delivery of the shipment to the Client or their authorized representative.
  4. If a shipment cannot be assigned to a Client, Swiss Paket will attempt to identify the Client using the logistical means at its disposal. This may require opening the package to find documents with the customer number or recipient's name. If identification fails, the shipment will be stored for 2 weeks. After the two-week storage period, the shipment will be returned to the sender. If costs arise for the return, Swiss Paket is entitled to return the parcel at the sender's expense.
  5. If the general storage period of 2 months is exceeded and there is no request to extend the storage period, the return policy described in point 6.4 applies.

7. Acceptance / Cash on Delivery and Freight Collect / Refusal of Acceptance

    In principle, neither written nor oral notifications or agreements regarding the acceptance of "FREIGHT COLLECT" (unfrei) shipments will be considered! These parcels will be refused. Cash on delivery shipments (including shipments with customs duties) will also not be accepted!
  1. The following shipments / deliveries may not be sent to Swiss Paket:
    1. Shipments whose storage violates legal or official prohibitions, whose storage is subject to national dangerous goods regulations, or whose storage is subject to special requirements.
    2. Shipments with insufficient packaging, particularly with liquid contents, unless leak-proof and protected against breakage.
    3. Shipments with perishable goods or goods prone to damage that require special protection against heat or cold.
    4. Shipments containing live animals or parts/remains of animals or humans.
    5. If there is imminent danger caused by a shipment delivered to us, Swiss Paket is entitled to take all measures to avert or reduce the danger.
  2. DHL deliveries are made via an electronic list to us. It may happen that DHL shipments are marked as "Delivered" in the tracking history even though they have not actually arrived. For such parcels, we need your feedback; we will then file a claim with DHL. Please note that DHL is liable here, and we cannot make any compensation payments unless DHL refunds the loss to our account instead of the sender's account.

8. Mail and Receipt Notification

    Swiss Paket customers are informed via email about the arrival of a shipment addressed to them as soon as it has been entered into the system. Swiss Paket reserves a time span of at least 6 hours between the arrival of a shipment and the sending of the email.
  1. Swiss Paket assumes no liability for the proper delivery to the specified email addresses, nor will any refunds or credits be issued due to alleged "non-delivery" of notifications.
  2. Email notifications are sent exclusively to the provided address. To ensure delivery, the customer must ensure that the email address from which notifications are automatically generated is on the "Safe Senders" list (Whitelist).
  3. Changes regarding the form of notification, email addresses, or other customer data can only be made by the customer themselves under their own responsibility or by a Swiss Paket employee upon written request.
  4. All emails from Swiss Paket and any attached files are transmitted in unencrypted form and contain confidential information intended solely for the addressee. Swiss Paket assumes no liability for the proper, complete, and delay-free transmission of this message. Any use by third parties is prohibited. If you receive a message in error, you are obliged to notify the sender and completely delete the message and all attachments from your system.

9. Ancillary agreements and deviating arrangements require the written form.

10. Severability / Jurisdiction

  1. Severability Clause: Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by one that comes as close as possible to its economic purpose.
  2. The place of jurisdiction is Waldshut, Germany. Status: 01.09.2017.
